Tutoring terms and conditions – Chaptr House of Education, LLC

1. Services
1.1 Packages
Once your package booking is accepted, Chaptr House of Education will match you with a Tutor and the Tutor will contact you to arrange an introductory session. You are responsible for replying to the Tutor’s email. If you do not respond, we may need to arrange a replacement Tutor, and you may lose access to Tutoring Hours included in your Package without any right to a refund.
Tutor Sessions will be scheduled directly between you and the Tutor.
Non-attendance: If the Student does not join the session, the Tutor will wait for up to 15 minutes before marking the session as a missed session.
Tutoring Hours are personal to the Student and may not be transferred to another student, household, or account unless expressly approved by Chaptr House of Education, LLC.
Chaptr House of Education, LLC reserves the right to refuse service or discontinue a Package if the Student engages in disruptive, abusive, or inappropriate behavior.
1.2 Courses
Before each course session, you will receive email instructions about how to join. It is your responsibility to ensure you can access the Course. No refunds will be issued for non-attendance, regardless of reason.
Chaptr House of Education may assign any suitable Tutor to lead each course session.
2. Delivery of Services
All tutoring and course sessions are conducted online. Tutors will send invitations or instructions using the email address provided.
Chaptr House of Education provides Services with reasonable skill and care but does not guarantee any specific academic outcome.
If your booking involves support for official school assignments, it is your responsibility to ensure you are allowed to receive such support under your school’s rules.
You are responsible for ensuring that you have the required technology, internet connection, and equipment to participate in online tutoring. Chaptr House of Education, LLC is not responsible for interruptions caused by the Student’s devices, software, or connectivity issues.
You acknowledge that online sessions may be recorded by the Tutor for quality assurance or training purposes, but only with your explicit written consent. Unauthorized recording by the Student or parent is strictly prohibited.
3. Tutors
All Tutors engaged by Chaptr House of Education have relevant academic backgrounds and have passed our recruitment process.
Tutors are independent contractors of Chaptr House of Education.
As independent contractors, Tutors are not employees of Chaptr House of Education, LLC. We are not liable for their personal conduct outside tutoring sessions or for events occurring beyond the scope of the Services.
We reserve the right to change your Tutor when necessary.
You may not solicit or hire a Tutor directly during your Service period or for 12 months afterward. If this condition is breached, we may charge a fee equal to the Tutor’s compensation for the previous 24 months (or their average monthly compensation multiplied by 24, if engaged for a shorter time).
You agree not to request or encourage communication with the Tutor outside approved channels, including personal phone numbers, social media, or personal email addresses.
4. Use of the Site and Services
You and the Student must comply with all applicable laws when using the Site and Services. You may only access the Site through approved interfaces and may not use it in ways that infringe Chaptr House of Education’s rights or the rights of others.
You agree not to use the Services to engage in cheating, plagiarism, or any activity that violates academic integrity policies. Chaptr House of Education, LLC may immediately suspend Services if academic misconduct is suspected.
You are responsible for all activity under your Account. Account login details must be kept secure and may only be shared with the Student as needed for tutoring. If you believe your Account has been accessed without permission, you must notify us immediately.
Chaptr House of Education, LLC is not responsible for any loss or damage arising from unauthorized access to your Account resulting from your failure to safeguard login credentials.
We may suspend Services to resolve technical issues or to comply with legal or regulatory requirements. When reasonably possible, we will notify you in advance.
We may decline or adjust an order or close your Account if false or incomplete information is provided, or if you fail to comply with these Terms. We may request that you correct any issues before reinstating access.
We reserve the right to monitor the use of our Site and Services to ensure compliance with these Terms.
5. Cancellations and No-Shows
You may cancel a Tutor Session by contacting the Tutor via email no later than 24 hours before the scheduled start time.
If the Student misses a session or cancels less than 24 hours in advance, the Tutoring Hour will be deducted from your Package.
Because Course Sessions involve multiple participants, they cannot be cancelled or refunded. If you contact us well in advance about a session you cannot attend, we may, at our discretion, offer alternatives or make exceptions.
If we need to cancel or reschedule a Tutor Session, we will notify you as soon as possible. If you participate in rescheduling, the hour will not be deducted. If a Tutor fails to attend, no Tutoring Hour will be deducted.
Course Sessions may be cancelled or rescheduled with advance notice when necessary.
Repeated cancellations or disruptive scheduling behavior may result in suspension of Services, at our discretion.
If your Tutor repeatedly misses sessions, you must notify us immediately so that we may assign a replacement.
6. Payment Information
To keep our administrative costs low and our tutoring rates fair for all families, Chaptr House of Education accepts payments exclusively by check or Zelle. These methods allow us to avoid high processing fees, ensuring that more of your tuition goes directly toward instruction rather than overhead.
All payments must be made in advance unless otherwise stated. We accept the payment methods listed on our Site.
By submitting payment information, you authorize CHAPTR House of Education, LLC to charge your selected payment method for all fees associated with your Booking.
Chargebacks or disputed transactions may result in immediate suspension of Services. We reserve the right to recover any costs associated with resolving a chargeback.
7. Term and Termination
These Terms take effect when you create an Account.
• For Packages, these Terms remain in effect while valid Tutoring Hours remain.
• For Courses, these Terms remain in effect until the final Course Session in your Booking has taken place.
Unused Tutoring Hours are valid for one year from the start date of the Package. Hours not used within the validity period will expire without refund.
We may terminate this contract with 24 hours’ notice if you or the Student breach these Terms or fail to make required payments.
Upon termination, access to all Services will end immediately. Any outstanding fees must be paid, and refunds will not be issued except where required by applicable withdrawal rights.
Required personal information will be deleted or anonymised unless we are legally required to retain it.
Obligations arising from breaches of these Terms will remain enforceable after termination.
We may immediately suspend or terminate Services if we suspect fraud, misuse, harassment, inappropriate behavior, or any breach of academic integrity.
Termination does not relieve you of responsibility for unpaid fees.
8. Pricing
You must pay the fees listed on our Site for the Services you select. Fees include all applicable taxes. Prices may change, but not after a Booking has been confirmed.
Packages are prepaid and non-refundable. Any Tutoring Hours not used within the one-year validity period, or lost due to late cancellations or missed sessions, will expire without refund.
Promotional pricing, discounts, or coupons cannot be applied retroactively.
We reserve the right to correct pricing errors even after a Booking is submitted, provided the correction is communicated promptly.
9. Legal Notices (United States)
9.1 Business Entity
Chaptr House of Education, LLC (“we,” “us,” or “our”) is a Limited Liability Company organized under the laws of the State of Texas.
9.2 Governing Law
These Terms are governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.
Because Chaptr House of Education, LLC provides Services nationwide, you agree that any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Texas, unless arbitration applies under Section 9.7.
9.3 Nationwide Availability
Chaptr House of Education, LLC provides tutoring services throughout the United States. It is your responsibility to ensure that receiving tutoring complies with the laws, regulations, and school or district rules applicable in your state or academic institution.
9.4 Limitation of Liability
To the fullest extent permitted under Texas and U.S. law, Chaptr House of Education, LLC and its Tutors are not liable for any indirect, incidental, punitive, special, or consequential damages, including loss of data, loss of academic opportunities, business interruption, or reputational harm.
Our maximum total liability for any claim will not exceed the fees you paid in the three (3) months preceding the event giving rise to the claim.
9.5 No Guarantee of Academic Results
Chaptr House of Education LLC does not guarantee admission to any school or university, improvement in grades, or achievement of any particular academic outcome.
9.6 Parental Responsibility for Minors
If the Student is under 18, the parent or legal guardian agrees to supervise the Student’s use of the Services and remains fully responsible for compliance with these Terms.
9.7 Dispute Resolution & Arbitration
Before initiating legal action, both parties agree to attempt to resolve disputes through good-faith discussion.
If unresolved, any dispute will be submitted to binding arbitration in Texas, unless prohibited by applicable state law.
You waive the right to participate in any class-action lawsuit or class-wide arbitration.
9.8 Intellectual Property
All content provided by Chaptr House of Education, LLC—including lessons, worksheets, videos, curricula, and teaching methods—remains our intellectual property. You may not copy, share, distribute, or reuse these materials without written permission.
9.9 Compliance With School Policies
You are solely responsible for ensuring that assistance with assignments or coursework is allowed under your school’s policies.
Chaptr House of Education, LLC is not responsible for violations of academic integrity rules.
9.10 Force Majeure
We are not liable for delays or service interruptions caused by events outside our reasonable control, including natural disasters, illness, platform failures, power outages, or other unforeseeable conditions.
